TERMS & CONDITIONS
1. INTERPRETATION
1.1. “The Act” means the Consumer Protection Act 68 of 2008.
1.2. “Competition” means the Competition being undertaken herein pertaining to the Promoter as detailed in their Competition Rules.
1.3. “Competition Rules” means the rules contained herein pertaining to the Promotional Competition as required by Section 36 of the Act.
1.4. “Participant” means any natural person who qualifies in terms of clause 3 hereof.
1.5. “Personal Information” means Data Protection and Privacy Policy to which their Competition Rules relate and which can be sourced at www.wisani.co.za or www.nlafunerals.co.za
1.6. “Promoter” means Wisani Burial Society CC and NLA Funeral Services (PTY) Ltd and any promotional partners or related entities.
1.7. “Promotional Competition” means the Competition to which these rules pertain as run by the Promoter during the Promotion Period.
1.8. “Promotion Period” means 00:00 1 July 2025 to 24:00 30 June 2026, or any period communicated by the Promoter.
1.9. “POPIA” means the Protection of Personal Information Act No. 4 of 2013.
1.10. “Processing” means any operation or activity.
1.11. “Prize” means any prescribed prize(s) or benefit(s) as determined by the Promoter in respect of the Promotional Competition, the particulars of which will be published per the provisions of Schedule 1 below.
1.12. “Wisani Burial Society” means a close corporation with registration number 2009/026912/23.
1.13. “NLA Funeral Services” means a private company with registration number 2018/380485/07.
1.14. “Winner” means the Participants who are successful in the Promotional Competition and are notified as such by the Promoter in terms of 10.2.1.
2. INTRODUCTION
2.1. The Promoter is offering a Promotional Competition in which participants are automatically entered, subject to the terms and conditions contained herein, into the Promotional Competition to win one of the prizes.
2.2. The following rules, terms, and conditions are imposed by the Promoter in terms of Section 36 of the Consumer Protection Act 68 of 2008.

3. ENTRANCE
3.1. The Competition Rules contain certain terms and conditions which may:
3.1.1. Create risk or liability for the Participant; and/or
3.1.2. Compel the Participant to indemnify the Promoter or a relevant third party; and/or
3.1.3. Limit the risk or liability of the Promoter, or any relevant third party; and/or
3.1.4. Serve as an acknowledgment, by the Participant, of certain facts; and/or
3.1.5. Require the Participant to consent to the Processing of his or her Personal Information/Personal Data for the purposes identified in clause 11.
4. PARTICIPANTS
4.1. The participants must be:
4.1.1. A natural person,
4.1.2. Reside in South Africa,
4.1.3. 18 years or older,
4.1.4. A Wisani Burial Society Plan E Policy Holder or an NLA Funeral Services Achiever Policy Holder.
4.2. Participants are eligible to enter automatically by being the Main Member, as defined by the Wisani Burial Society Policy, of a “Plan E” policy and the NLA Funeral Services Policy, of an “Achiever” policy.
4.3. Participants are eligible to participate in the competition subject to the terms and conditions listed in clause 5.
4.4. The Participant expressly acknowledges that by entering into the Promotional Competition, he/she understands and thereby agrees to the Competition Rules.
4.5. It is a material term of the Promotional Competition that all Participants to this Promotional Competition participate entirely at their own risk and can withdraw at any time with reasonable notice to the Promoter.
4.6. No director, employee, agent, or consultant of the Promoter or organizer, or their spouses, life partners, business partners, immediate family members, or the supplier of goods and services in connection with this Competition may participate in this Competition.
4.7. Anyone who, within 180 days preceding this Competition, has won any competition organized, promoted, or conducted by the Promoter, who resides at the same address as such a Winner, or who uses the same telephone number and/or email address to enter this Competition may not participate in this Competition. Should such individual(s) participate in this Competition as a Participant, such individual shall not be eligible to become a Winner as contemplated in terms of these Competition Rules.

5. ENTRY RULES
5.1. To enter this competition, participants are required to:
5.1.1. Make their Wisani Burial Society Plan E payments or NLA Funeral Services Achiever payments at any Wisani or NLA branch, Wisani or NLA Pay Point, any Pay@ outlet, or via Debit Order.
5.1.2. Pay their Wisani Burial Society Plan E Policy or NLA Funeral Services Achiever Policy monthly premium within the current month.
5.2. One payment will equal one entry into the competition.
5.3. Participants must retain all receipts of proof of payment of their premiums in terms of their policies.
5.4. Entries will be limited to 24 entries per member.
5.5. To enter, the payment should be made on time and during the relevant Promotion Period.
5.6. Back payments shall not be accepted as entries and will thus be disregarded for purposes of determining the Finalists as contemplated in clause 10.1.3.
6. THE PRIZES
6.1. There are various Prizes to be won at the end of the Promotion Period.
6.2. The particulars of the various Prizes, the date upon which and the manner through which such Prizes will be awarded and distributed shall be listed in Schedule 1 of the document.
6.3. The Prizes, dates, terms, and conditions listed in Schedule 1 are subject to change, which will be communicated by the Promoter to the Participants within a reasonable time, via the Promoter’s social media and any other form of communication as listed in each participant’s respective policy.
6.4. The Participant’s Personal Information/Personal Data will be utilized by the Promoter to distribute the prizes.
6.5. It is specifically recorded that the Participant understands and acknowledges that the Promoter will not be held responsible for Prizes distributed to Winners who have supplied incorrect Personal Information/Personal Data required for the Prize to be awarded.

7. THE RULES
7.1. The following rules apply to the Promotional Competition:
7.1.1. Participants must ensure that their Policy details with the Promoter are up to date.
7.1.2. The Promoter reserves the right to amend these Competition Rules by bringing them to the Participants’ attention within a reasonable period and may terminate the Promotional Competition at any time. In such an event, where the Promotional Competition is terminated or suspended, all participants agree to waive any rights they have in terms of the Promotional Competition and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors.
7.1.3. In the event of a dispute, the decision of the Promoter will be final and binding, and no correspondence will be entered into. In this regard, and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by the Participant to follow the Competition Rules) at their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants from this Promotional Competition.
7.1.4. Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of these Competition Rules by a Participant, as determined at the Promoter’s discretion, may result in disqualification from the Promotional Competition and ineligibility to win any Prizes.
8. INDEMNITY
8.1. Should the Promoter, law, or any authority terminate this Promotional Competition, no notice of termination shall be required. In such an event, all participants waive any right and acknowledge that they indemnify and hold harmless the Promoter, promotional partners, directors, employees, and agents (“related entities”) of any liability pertaining to any damage, cost, injuries, and losses of whatsoever nature and however arising as a result of their participation in the Promotional Competition and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, or any claims in terms of POPIA.
8.2. The Participant accepts that the Promoter and related entities will not be responsible for any costs, damage, or otherwise, however, incurred by the Winner after claiming the relevant Prizes.

9. PRIZE QUALIFICATION RULES
9.1. Participation in the Promotional Competition constitutes acceptance of the Competition Rules.
9.2. By entering the Promotional Competition, Participants consent to their Personal Information/Personal Data being used for any marketing campaigns undertaken by the Promoter.
9.3. The Finalists will be notified through the publication of the results as contemplated in clause 10.1.6.
9.4. A Prize may not be handed over to a Finalist and/or Winner when it is prohibited by law for the Winner to use the Prize. When required, the Finalist/Winner must prove their eligibility to use the Prize. Once a Winner has been notified and the prize has been handed over, the Winner must acknowledge receipt of the Prize.
9.5. As contemplated in clause 6.3, the Promoter reserves the right to substitute any of the Prizes with any other prize of similar commercial value to the prizes offered in Schedule 1, at its sole discretion.
9.6. Participants who keep their policy up to date, and on time, consecutively throughout the competition, from the date on which they are entered as Participants, will automatically be granted double the amount of entries at the end of the Promotional Competition.
10. BASIS ON WHICH PRIZE WINNERS ARE DETERMINED
10.1. 1st DRAW
10.1.1. The 1st Draw will take place on a date and time to be communicated by the Promoter in due and reasonable time before the 1st Draw.
10.1.2. In the 1st Draw, 20 finalists’ names will be drawn, which will then be published on the Promoter’s Social Media Sites after the Promotional Period.
10.1.3. The Finalists will be determined by way of an internal system that randomly selects the 20 names from the eligible entries.
10.1.4. A Participant’s name may only be drawn once, meaning one entry per participant when determining the 20 finalists.
10.1.5. Any name drawn in duplicate will be disregarded to determine the 20 finalists of the 1st Draw.
10.1.6. All Finalists will be contacted directly using the information provided in their respective policy documents. The promoter will not be held liable for the finalist’s failure to receive the prize if the finalist’s contact details are incorrect. If the promoter cannot make contact with any finalist after taking reasonable steps to do so (within 24 hours from the draw), the finalist will forfeit the entry, and the promoter may, at their sole discretion, choose to conduct another random draw to replace the finalist.

10.1.7. The Finalist’s Reward will be deposited into the nominated bank account of each finalist within 7 (seven) days of receipt of a bank confirmation letter from the finalist.
10.2. 2nd DRAW
10.2.1. The 2nd Draw to determine the final winners will take place during the Final Draw Event, hosted by Wisani and NLA, on a date and time to be communicated by the Promoter in due and reasonable time before the 2nd Draw.
10.2.2. The participants agree to and understand that should their name be selected in the draw, and they win a prize, a photograph of the winner together with a staff member of Wisani and NLA may be published on the Wisani and NLA social media channels and website.
10.2.3. The Winners of the competition will be announced on the day of the 2nd Draw as set out in this competition’s terms and conditions. Thereafter, the names of the winners will be published on the Wisani and NLA social media pages and website.
10.2.4. All finalists must be present at the Final Draw Event, hosted by Wisani, to participate in the 2nd Draw. Should the Finalist not be able to attend, they shall forfeit their entry, and another finalist will be selected to replace them. No prizes will be released to any person who is not the Finalist.
10.2.5. All Finalists will participate in the 2nd Draw to determine their prize.
10.2.6. The prizes will be released by the Promoter to the finalist in the manner contemplated in Schedule 1 of this document.
11. PERSONAL INFORMATION/ PERSONAL DATA
11.1. The Promoter undertakes to process any Personal Information/ Personal Data in a manner that adheres to the requirements of the Protection of Personal Information Act 4 of 2013 and promotes the constitutional right to privacy and retains accountability.
11.2. The Promoter may from time to time process any Personal Information/ Personal Data by making use of automated and or systematic means to make decisions about the Participants or their participation. In this instance, it is specifically recorded that the Participant may object to or query the outcome of such a decision.
11.3. The Participant, by participating in the Promotional Competition, expressly consents to his/her Personal Information/Personal Data being processed for the following purposes:
11.3.1. Ensure that the Participant is eligible to participate in the Promotional Competition.
11.3.2. To share the Participant’s Personal Information/Personal Data with the Promoter’s promotion partner and/or any related entity.

11.3.3. To provide and manage any information and Services requested by the Participant in general and in her/his capacity as Customer of the Promoter.
11.3.4. To establish a Participant’s needs, wants, and preferences concerning the Services provided by the Promoter or any other Third Party or Customer(s) with whom the Promoter shares the Participant’s Personal Information/Personal Data.
11.3.5. To help the Promoter identify Participants when they engage with the Promoter via the various Campaign Site(s) and Marketing Channels.
11.3.6. To allocate unique identifiers to Participants to securely store, retain, and recall their Personal Information/Personal Data from time to time.
11.3.7. To maintain records of Participants for research and statistical purposes.
11.3.8. To carry out analysis and profiling of the Participant.
11.3.9. To identify other products and services that might be of interest to the Participant and the Promoter’s Customer(s) and Data Subjects in general, as well as to inform them of any Third-Party Products and Services.
12. OBJECTION TO THE PROCESSING OF PERSONAL INFORMATION/ PERSONAL DATA
12.1. If any Participant wishes to object to the Processing of his or her Personal Information/Personal Data, which right the Participant is at all times entitled to exercise, the Participant must direct such a request to the Promoter’s Information Officer at the following email address: winacar@wisani.co.za.
13. OBJECTION TO THE PARTICIPATION IN THE PROMOTIONAL COMPETITION
13.1. If any Participant wishes to object to the Participation in the Promotional Competition, which right the Participant is at all times entitled to exercise, the Participant must direct such a request to the Promoter’s Information Officer at the following email address: winacar@wisani.co.za. A copy of the Promotional Competition rules is available at no cost at www.wisani.co.za and www.nlafunerals.co.za.
14. PRIVACY DISCLOSURES
14.1. The participant agrees to and understands that should their name be selected in the draw and they win a prize, their name may be published on the Wisani social media channels and website.
14.2. The participant agrees to and understands that should their name be selected in the draw and they win a prize, a photograph of the winner together with a staff member of Wisani may be published on the Wisani social media channels.
14.3. The Wisani NLA Win-a-Car Extravaganza Competition Rules and Terms & Conditions are available to any participant upon request and at no cost to the participant.

Prizes will be distributed as follows:
PHASE 1
1. Selection of Finalists:
1.1. 20 (Twenty) Participants’ names will be selected from a draw.
1.2. These participants will be referred to as the finalists.
2. Contacting Finalists:
2.1. The promoter will contact the finalists using the contact details provided on the policy document.
2.2. The promoter will not be held liable for the finalist’s failure to receive the prize if the finalist’s contact details are incorrect.
2.3. Suppose the promoter cannot contact any finalist after taking reasonable steps to do so (within 24 hours from the draw). In that case, the finalist will forfeit the entry, and the promoter may, at their sole discretion, choose to conduct another random draw to replace the finalist.
3. Cash Reward for Finalists:
3.1. Each finalist will be awarded cash in the amount of R500.00.
3.2. The money will be deposited into the nominated bank account of each finalist within 7 (seven) days of receipt of a bank confirmation letter from the finalist.
4. Publication of Finalists’ Names:
4.1. A participant’s name may only be drawn once. Any name drawn in duplicate will be disregarded to determine the 20 finalists.
4.2. The participants agree and understand that should their name be selected in Phase 1 of the draw, their name may be published on the promoter’s social media channels and website.

PHASE 2
1. Eligibility for Phase 2:
1.1. Only the 20 finalists selected in Phase 1 will be eligible for Phase 2.
2. Attendance at Final Draw Event:
2.1. All finalists must be present at the Final Draw Event, hosted by the promoter, to participate in Phase 2 of the draw.
2.2. If a finalist cannot attend, they shall forfeit their entry, and another finalist will be selected to replace them.
2.3. No prizes will be released to any person who is not the finalist or an accepted nominated person of the finalist.

4. Prize Collection and Requirements:
4.1. The cash prizes will be deposited into the nominated bank account of each winner within 7 (seven) days of receipt of a bank confirmation letter from the winner.
4.2. The winner must provide the promoter with the required documentation to register the vehicle in the respected legal name, at the promoter’s cost.
4.3. The winner (or a nominated driver of the winner) must have a valid driver’s license before the vehicle will be released.
4.4. The winners must collect their prizes from the promoter’s Head Office in Tzaneen (84 Agatha Street, Tzaneen, 0850), as arranged by the promoter, at their own expense.
4.5. All prizes should be claimed at the promoter’s offices within 7 days after the promoter has contacted the winner. Failure to do so will result in forfeiture of the prize.
4.6. The participants agree and understand that should their name be selected in the draw and they win a prize, a photograph of the winner together with a staff member of the promoter may be published on the promoter’s social media channels and website.
4.7. The winners of the competition will be announced on the day of the first draw as set out in this competition’s terms and conditions. Thereafter, the names of the winners will be published on the promoter’s social media pages and website.
4.8. The promoter will not be liable for any costs or expenses in respect of the prize, including, but not limited to: costs and expenses relating to the collection, delivery, possession, insurance, use, or maintenance of the prize.
4.9. Prizes are non-transferable and cannot be exchanged for cash. The promoter will require identification on the collection of prizes.
4.10. The promoter shall not be held liable for any claims, liability, damages, loss, cost, or expenses whatsoever which are suffered by any person (including but not limited to indirect or consequential loss) as a result of or arising from participation in this competition or the use of the prize awarded. By entering this competition, the participant agrees to release, indemnify, and hold the promoter, its subsidiaries, agents, contractors, marketing, and promotional agencies harmless from any claims, liability, damages, costs, and expenses arising out of his/her participation in the prize draw and/or acceptance and/or use of any prizes.
